Brazil is developing a comprehensive AI Bill modelled partly on the EU AI Act. The proposed legislation would prohibit specific high-risk AI systems, establish a dedicated regulatory body, impose civil liability on AI developers and deployers, require reporting of security breaches, and guarantee individuals the right to understand AI-driven decisions and to correct identified biases. Brazil’s approach adapts the EU risk-based model to its domestic legal and social context. As of March 2026, the bill is still moving through the legislative process and has not been enacted.

Who it affects: When enacted, the bill would affect AI developers and deployers across all sectors in Brazil. The civil liability provisions are broader than most comparable legislation. The right to explanation for AI-driven decisions would give individuals legal recourse against automated decisions that affect them.

What is notably missing: No provisions on AI education or literacy in the draft as reported. No mandatory training requirements for workers or students. The bill focuses on system-level regulation and individual rights without addressing whether people have the knowledge to exercise those rights. A right to explanation is only as useful as the person’s ability to understand and act on the explanation they receive.
